By accessing or using our website, Heartbeat community, services, or products, you (“you,” “your”) agree to be bound by these Terms of Service (“Terms”). Please read them carefully. These Terms govern your use of our website(s), Heartbeat community, services, and products, including any associated memberships, digital downloads, or events. By using our website, Heartbeat community, or services, you agree to these Terms of Service. If you do not agree, you must discontinue use of our services.

4. Agreement to Receive Text Messages
By providing your mobile number, you agree that Moms with ADHD may send you periodic SMS or MMS messages containing but not limited to important information, reminders, updates, and specials.

Messages may be in SMS or MMS format and may contain marketing/promotional content.

Messages may be sent using an automatic telephone dialing system.

United States Participating Carriers Include AT&T, T-Mobile®, Verizon Wireless, Sprint, Boost, U.S. Cellular®, MetroPCS®, InterOp, Cellcom, C Spire Wireless, Cricket, Virgin Mobile and others.

T-Mobile is not liable for delayed or undelivered messages.

You agree to notify us of any changes to your mobile number and update your account with us to reflect this change.

Data obtained from you in connection with this SMS service may include your cell phone number, your carrier’s name, and the date, time and content of your messages, as well as other information that you provide. We may use this information to contact you and to provide the services you request from us.

By subscribing or otherwise using the service, you acknowledge and agree that we will have the right to change and/or terminate the service at any time, with or without cause and/or advance notice.

Though we will never charge you for the text messages you receive, depending on your phone plan, you may see some charges from your mobile provider. Please reach out to your wireless provider if you have questions about your text or data plan.

5. Payments, Refunds, and Cancellations

Payments: All fees for services or products must be paid upfront unless otherwise stated. Accepted payment methods will be specified at checkout.

Refunds: Payments are non-refundable unless otherwise explicitly stated in the service agreement or as required by applicable law.

Cancellations: Paid subscriptions may be terminated (“cancelled”) by requesting a cancellation by emailing MomswithADHD@gmail.com which will prevent further charges from being made to your account. You will continue to have access to the subscription through the end of the term already paid for and no refund of an unused or any other portion of the term will be provided, unless at our sole discretion.

6. Use of Services
You agree to use our services for personal, non-commercial purposes unless explicitly agreed otherwise. Unauthorized use, such as reselling or redistributing our materials without permission, is prohibited.

7. Intellectual Property
All content provided on our website or through our services, including but not limited to posts, comments, blogs, course materials, templates, and tools, is the exclusive property of Judy Maynard Consulting. You may not reproduce, distribute, or modify any of our content without prior written consent.
8. Prohibited Activities
You agree not to:

Use the website or services in a way that disrupts others’ access.

Attempt to bypass security measures.

Misuse our intellectual property.

Submit false or misleading information.
Violations may result in termination of access to our services.

9. Community Guidelines
For programs involving group coaching or community interaction:

Maintain respectful and professional behavior.

Do not share other members’ information or member-posted content without consent.

Avoid spamming or promoting unauthorized products/services.

10. Event Participation
For events, including webinars and masterclasses:

Registration fees must be paid in advance (if applicable).

We reserve the right to modify or cancel events and will notify participants as early as possible in such cases.

11. Limitation of Liability
Judy Maynard Consulting is not liable for any indirect, incidental, or consequential damages arising from the use of our services, including lost opportunities, unless explicitly stated in your agreement.

12. Termination
We reserve the right to suspend or terminate access to our services without prior notice for violations of these Terms or other applicable policies.

13. Amendments
Original Effective Date: January 1, 2025. We may update these Terms periodically. Changes will be posted in the Heartbeat community, and/or on our website www.momswithadhd.org and your continued use of our services constitutes acceptance of the updated Terms.

14. Governing Law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law principles.
